HSE to prosecute following fatal wall collapse in 2016

Two recycling firms are to be charged over the deaths of five African men who were fatally crushed by a collapsing wall at a site in Birmingham over four years ago.


Ensco 10101 Limited (previously known as Shredmet Ltd) and Hawkeswood Metal Recycling Limited face charges under Sections 2(1) and 3(1) of the Health and Safety at Work Act 1974.

HSE announced the decision to prosecute after four and a half years since the incident took place on 7 July 2016. It follows a joint investigation by HSE and West Midlands Police.

A prosecution has also been approved against two individuals.

It follows a protest, held on 7 July this year, which saw more than 50 people including the bereaved wives and families of the men gathering outside the metal plant to demand justice.

On 7 July 2016, Ousmane Kaba Diaby, Saibo Sumbundu Sillah, Bangally Tunkara Dukuray, Almamo Kinteh Jammeh and Mahamadou Jagana Jagana were all fatally crushed by a collapsing wall at Hawkeswood Metal Recycling site, owned by Shredmet.  It was located on Aston Church Road in Nechells area of Birmingham. A sixth man, Tombong Camara Conteh sustained serious injuries.

The first court hearing is yet to be confirmed.
